CONDITIONS OF USE OF THE WEB SITE

2.- Object.
The present conditions of use (hereinafter, the "Conditions of Use", or the "Conditions") regulate the rights and obligations of Bit Base and of the users in relation to the access, navigation and use of the present Web Site, without prejudice that the provider reserves the right to modify, without previous warning, the content of the same ones.
In any case, the access by the user to the Web Site once such modification takes place implies the acceptance of the Conditions and the modifications introduced by the user.
However, access to certain content and the use of certain services may be subject to certain special conditions, which will be clearly displayed in any case, and must be expressly accepted in advance by users. These special conditions may replace, supplement or, where appropriate, modify these Terms of Use.
In this sense, and without prejudice to the provisions of these Terms of Use, the contracting of any product and/or payment service offered by the Provider shall be governed by the general and/or particular conditions of each specific service provided for such purpose.
For the purposes of the interpretation of these Terms of Use, we understand that a person becomes a user at the moment he/she accepts the Terms of Use and the Privacy Policy, as well as the rest of the legal texts and policies of use that are accessible from the Web Site, being sufficient the navigation by the user to understand that he/she accepts them in a conscious and informed way.
3.- Access to the website
Access to most of the contents of the Web Site is completely free of charge and does not require prior registration.
Access to the Website by minors is prohibited. However, in the event of access to the Website and registration by a minor, it shall be presumed that such access has been made with the prior and express authorization of their parents, guardians or legal representatives, without prejudice to the fact that the provider reserves the right to carry out as many verifications and checks as it deems appropriate.
Under no circumstances will the provider be responsible for the veracity of the registration data provided by users, so each of them will be solely responsible for the information provided to Bit Base is adequate, accurate and precise or, otherwise, for the possible consequences that may arise from the lack of quality of the data.
4.- Intellectual and industrial property rights.
The provider is the owner or, where appropriate, has the corresponding licenses on the rights of exploitation of intellectual and industrial property on the design and programming of the Website, as well as all the contents offered therein, including, but not limited to, the platform itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content available through the same.
In no case shall it be understood that the access, navigation and use of the Website by the user or the use, acquisition and/or contracting of products or services offered through the same implies the waiver, transmission, license or total or partial transfer of said rights by the provider in favor of the user. The user has the right to use the contents and/or services of the Web Site within a strictly domestic scope, for access and navigation through the Web Site, and solely for the purpose of enjoying the benefits of the service in accordance with these Terms of Use.
References to registered trademarks or trade names, or other distinctive signs, whether owned by the provider or by third parties, imply a prohibition on their use without the express written consent of the provider or their legitimate owners. At no time, unless expressly stated otherwise, access, navigation or use of the Web Site and / or its contents gives the user any right over the distinctive signs, content or services included therein.
All intellectual and industrial property rights over the contents and/or services of the Web Site are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and under any form, all or part of the contents included in the Web Site, for public or commercial purposes, without the prior, express and written authorization of the provider or, if applicable, of the holder of the corresponding rights.
Likewise, it is forbidden to remove or manipulate the copyright indications or other credits that identify the holders of the rights of the contents that the user finds in the Web Site, as well as the technical protection devices, digital fingerprints, or any protection mechanism or information incorporated to the contents offered in the Web Site.
In the event that the user sends information of any kind to the Provider through any of the channels provided for this purpose, the user represents, warrants and agrees that he/she has the right to do so freely, that such information does not infringe any intellectual property rights, industrial, trade secret or any other rights of third parties, and that such information is not confidential or cause any damage to third parties, assuming otherwise all possible liabilities arising.
If the user becomes aware of the existence of any content that is illicit, illegal, contrary to the law or that could involve an infringement of intellectual and/or industrial property rights, he/she must immediately notify the Provider by e-mail at the following addresslegal@bitbase.es so that the Provider may proceed to the adoption of the appropriate measures.
Likewise, in the event that any user or third party considers that any of the contents of the Web Site owned byBit Baseinfringes your intellectual and/or industrial property rights, as well as any other rights, you must send a communication to legal@bitbase.es with the following information:

- Documentation that accredits its status as owner of the allegedly infringed rights.
- Detailed account of the rights allegedly infringed by the provider, as well as their exact location within the Website.

5.- Conditions applicable to links and links.
5.1. Links to other websites.
In the event that the Website includes links to other web pages by means of buttons, links, banners or embedded content, the provider informs that these are directly managed by third parties, and the provider does not have the human or technical means to know in advance and/or control and/or approve all the information, content, products or services provided by other platforms to which links may be established from the Website.
Consequently, Bit Base will not be responsible for any aspect related to the platform or web page to which a link could be established from the Web Site, specifically, by way of example and not limitation, on its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
In this sense, if the users have effective knowledge that the activities developed through these third party web pages are illegal, and/or contravene morality and/or public order, they must immediately communicate it to the Provider in order to proceed to disable the access link to them, action that will be carried out as soon as possible from the moment the Provider has knowledge of this circumstance.
In any case, the establishment of any type of link from the Web Site to another external web page does not imply that there is any type of relationship, collaboration or dependence between the provider and the person responsible for said external web page.
5.2 Links to other platforms are the responsibility of Bit Base.
The Provider makes available to users links that allow access to the channels and pages of the Website that the Provider maintains on different platforms and social networks belonging to and/or managed by third parties (Facebook, Twitter, Google+ and YouTube, among others), from which it carries out the publication of information, as well as the promotion of products and/or services.
In no case the Provider will share with Facebook, Twitter, Google+ or any other social network to be incorporated in the future any private information of its users, limiting only the information published to Bit Base's own information and its products and/or services. In this sense, all the information that the user himself wishes to provide, or publish on these platforms outside the Bit Base website, will be under his own responsibility, not intervening the provider in this process.
The activation and use of these applications may entail the need for the user to identify and authenticate with your username and password, as well as where appropriate expressly accept the legal conditions associated with it. On having acceded to the above mentioned external networks, the user enters in an environment foreign to the Web site of Bit Base, and therefore, he knows and accepts that he acts in this sense under his exclusive responsibility.
For this reason, the user must exercise extreme caution in the evaluation and use of the information, contents and services existing in the linked channels, and on the information of his own or of third parties that he wishes to share in said channels.
6.- Links in other web pages with destination to the web site.
All users may establish links on their respective web pages to the Web Site, provided that they comply with the following conditions:
6.1. The link will not be able to reproduce the content of the Web Site or parts of the same one, except that it is done under the systems made available on the part of Bit Base.
6.2. The use of "frames" or systems that allow the creation of a "browser" or a "border environment" on the sections of the Web Site, which allow access to the content of the same from other websites or modify the appearance of the Web Site for the user is not allowed.
6.3. It is not permitted to make false, inaccurate or incorrect statements or indications about the Website and/or, in particular, to state or imply that the provider has authorized a specific link, or that it has supervised or assumed in any way the contents or services offered or made available on the web page where said link is established.
6.4. The web page on which the link to the Website is established shall not contain information or content that is illicit, contrary to morality and generally accepted good customs and public order, nor shall it contain content contrary to any rights of third parties, including intellectual and industrial property rights and/or the right to honor, personal or family privacy or self-image or any other right, or content contrary to the rules governing the protection of personal data.
The provider does not have the human or technical means to know, control or approve all information, content, products or services provided by other websites that have established links to the Website. The provider assumes no responsibility for any aspect related to the web page that establishes the link to the Web Site, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
7.- Conditions of use of the web site.
Bit Base declares that it is not allowed and, therefore, its consequences will be the sole responsibility of the user, the access or use of the Web Site for illegal or unauthorized purposes, with or without economic purpose. In particular, and without the following list having absolute character, it is prohibited:
1. Use the Web Site in a way that may cause damage, interruptions, inefficiencies or defects in its operation or in the computer systems of any third party or in the case of Bit Base.
2. Use the Web Site for the transmission, installation or publication of any viruses, malicious code or other harmful programs or files.
3. Use the Web Site to collect personal data from other users.
4. Use the Web Site illegally, against good faith, morality and public order.
5. Registering through the Website under a false identity, impersonating a third party or using a profile or performing any other action that may mislead other users as to the identity of the origin of a message.
6. Unauthorized access to any section of the Web Site, other systems or networks connected to the Web Site, any server of the Provider, or the services offered through the Web Site, by hacking or forgery, password mining or any other illegitimate means.
7. Breach, or attempt to breach, the security or authentication measures of the Web Site or any network connected to the Web Site, or the security or protection measures inherent in the content offered on the Web Site.
8. Carry out any action that causes a disproportionate or unnecessary saturation in the infrastructure of the Website or in the provider's systems or networks, as well as in the systems and networks connected to the Website.
9. Impeding the normal development of an event, contest, promotion or any other activity available through the Website or any of its functionalities, either by altering or attempting to alter, illegally or in any other way, the access, participation or operation thereof, or by falsifying the result thereof and/or using fraudulent participation methods, by means of any procedure, and/or through any practice that violates or infringes in any way these Terms of Use.
The breach of any of the above obligations by the user may lead to the adoption by the Provider of appropriate measures protected by law and in the exercise of its rights or obligations, and may lead to the deletion or blocking of the account of the offending user, without the possibility of any compensation for damages caused.
8.- Responsibilities and guarantees.
The Provider cannot guarantee the reliability, usefulness or accuracy of absolutely all the information and/or services of the Website, nor the usefulness or accuracy of the documentation made available through the Website.
Consequently, the provider does not guarantee:
1. The continuity of the contents of the Website.
2. The absence of errors in said contents.
3. The invulnerability, from the point of view of security, of the Website and/or the impossibility of violating the security measures adopted therein.
4. The lack of usefulness or performance of the contents of the Website.
5. And the damages caused, to himself or to a third party, by any person who infringes the conditions, rules and instructions that the provider establishes on the Website or through the violation of the security systems of the Website.
Nevertheless, the provider declares that it has taken all necessary measures, within its possibilities and the state of the art, to ensure the operation of the Web Site and minimize system errors and ensure the highest level of security for users, both from a technical point of view and the contents published on the Web Site.
The lender cannot guarantee the legality, reliability and usefulness of the contents supplied by third parties through the Web site, guaranteeing it only with respect to the contents published by Bit Base. If the user had knowledge of the existence of some illicit, illegal, opposite content to the laws or that could suppose an infraction of rights of third parties, it will have to notify it immediately to the lender so that this one can proceed to the adoption of the opportune measures.
In any case, the provider reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, the access, navigation, use, hosting and/or downloading of the content and/or use of services of the Web Site, with or without prior notice, to users who contravene any of the provisions detailed in these Terms of Use, without the possibility of the user being able to claim any compensation for this cause.
In the event that the user breaches these Terms of Use, the Provider may suspend or terminate the user's user account automatically and without prior notice, and in no event shall such suspension or termination entitle the user to any compensation whatsoever.
For these purposes, the Provider informs that it may inform and cooperate in due time with the competent police and judicial authorities if it detects any infringement of the legislation in force or if it suspects that a crime has been committed.
9.- Data protection.
In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, all personal data provided during the use of the website will be treated in accordance with the provisions of the Privacy Policy that every user must expressly accept in order to use and register in the system.
10. Applicable law, dispute resolution and competent jurisdiction.
The parties expressly agree that this contract shall be governed by and construed, in all its terms and conditions, in accordance with current Spanish law.
The parties expressly submit to the jurisdiction and competence of the Courts and Tribunals of Barcelona for any questions or differences that may arise from the interpretation, fulfillment and execution of this contract.
